Day 3 – 10Tax & VAT Filing — questions we get asked
Corporate Tax is charged at 0% on taxable income up to AED 375,000 and 9% on taxable income above that threshold. A separate 15% Domestic Minimum Top-up Tax applies to large multinational groups with consolidated global revenues of EUR 750 million or more. Qualifying Free Zone Persons can access a 0% rate on qualifying income if strict substance and transaction conditions are met.
VAT registration is mandatory once taxable supplies and imports exceed AED 375,000 in the preceding 12 months, or are expected to exceed it in the next 30 days. Voluntary registration is available from AED 187,500, which can be worthwhile if you incur significant recoverable input VAT.
Free zone companies are within the scope of Corporate Tax and must register and file — "free zones are tax-free" is the most expensive misconception in the market. A Qualifying Free Zone Person can apply 0% to qualifying income, but only if it maintains adequate substance in the free zone, derives qualifying income under the current activity list, prepares audited financial statements, complies with transfer pricing, and keeps non-qualifying revenue below the de minimis threshold of the lower of AED 5 million or 5% of total revenue. Breach the conditions and you pay 9% on all income and lose QFZP status for five years.
Small Business Relief lets a resident business with revenue of AED 3 million or less elect to be treated as having no taxable income for the period, which means no Corporate Tax to pay. It applies to tax periods ending on or before 31 December 2029. Free zone entities and members of multinational groups are excluded. The election has to be made in each qualifying period, and the revenue test is assessed period by period, so it is worth confirming eligibility every year rather than assuming it carries forward.
The FTA imposes administrative penalties for late registration, late filing and late payment, and they escalate over time. Late Corporate Tax registration alone carries a fixed penalty. Because penalties compound, the cheapest compliance strategy is always to register and file on time.
